Are you ready for Canada’s new privacy rules? A recent survey by the federal Privacy Commissioner’s office shows that most businesses don’t have the procedures in place to comply with the requirements.
The mandatory breach notification regulations under the Personal Information Protection and Electronics Documents Act (PIPEDA) come into effect on November 1st. They require organizations to report to affected individuals and the Privacy Commissioner on any security breach involving personal information that creates a “real risk of significant harm.”
Experts say the Government of Canada is moving in the right direction to protect privacy, but the impact on businesses is significant. Under the rules, organizations must track and keep records of all security breaches involving personal information for two years. Then there’s the thorny question of what constitutes a “real risk of significant harm.” Organizations that don’t comply can face stiff fines.
Proactive steps should be taken before the breach notification rules come into effect. You might elect to undergo a compliance audit, commit to a round of staff training, or look into revamping your organization’s breach response plan. As a start, it’s vital to make sure your organization understands the new rules.
